ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen gelten für alle Dienstleistungen, Termine, Buchungen und Vereinbarungen zwischen dem Tattoo Artist (nachfolgend „Dienstleister“) und Kundinnen bzw. Kunden (nachfolgend „Kunde“). Mit der Terminvereinbarung oder dem Absenden einer Anfrage erkennt der Kunde diese AGB an.

2. Termine und Anzahlung

(1) Ein Termin gilt erst dann als verbindlich, wenn eine Anzahlung in Höhe von 30 % des Gesamtpreises geleistet wurde.
(2) Anzahlungen sind grundsätzlich nicht rückzahlbar, unabhängig vom Grund der Absage.
(3) Absagen oder Terminverschiebungen müssen mindestens 14 Tage vor dem Termin erfolgen.
(4) Verschiebungen sind einmalig und bis zu 3 Monate ab ursprünglichem Termin möglich, sofern sie fristgerecht mitgeteilt wurden.
(5) Aufgrund begrenzter Kapazitäten und langfristiger Planungen können kurzfristig freiwerdende Termine nicht neu besetzt werden; dies ist Grundlage für die Nicht-Rückzahlbarkeit der Anzahlung.
(6) Anzahlungen sind nicht auf andere Personen übertragbar.

3. Widerruf und Terminverschiebung

(1) Eine Terminverschiebung oder Absage ist nur gültig, wenn sie spätestens 14 Tage vor dem Termin über einen der folgenden Wege kommuniziert wurde:

  • schriftlich per WhatsApp,

  • schriftlich per E-Mail, oder

  • persönlich.

(2) Mitteilungen über Social-Media-Plattformen (Instagram, TikTok, Facebook etc.) oder andere Kanäle werden nicht berücksichtigt und gelten nicht als wirksame Absage oder Verschiebung.

(3) Erfolgt keine fristgerechte oder gültige Mitteilung, verfällt die Anzahlung vollständig.

(4) Bei mehrfachen Verschiebungsanfragen entscheidet der Dienstleister nach eigenem Ermessen, ob ein neuer Termin vergeben wird.

4. Preise und Zahlungsbedingungen

(1) Die Preise richten sich nach Größe, Stil, Platzierung und Aufwand des Tattoos.
(2) Eine verbindliche Preisangabe ist erst nach Motiv- oder Konzeptbesprechung möglich.
(3) Der Restbetrag ist am Tag des Termins vollständig zu entrichten – bar oder per akzeptierter elektronischer Zahlungsmethode.

5. Gesundheit und Voraussetzungen

(1) Der Kunde bestätigt, mindestens 18 Jahre alt zu sein.
(2) Personen mit folgenden Bedingungen werden nicht tätowiert:

  • Blutgerinnungsstörungen

  • Einnahme blutverdünnender Medikamente

  • Schwangerschaft oder Stillzeit

  • Infektionen, Hauterkrankungen oder offene Wunden im Tattoo-Bereich

(3) Der Kunde verpflichtet sich, relevante gesundheitliche Einschränkungen vorab mitzuteilen.
(4) Der Dienstleister kann Termine aus gesundheitlichen Gründen ablehnen oder abbrechen, wenn Risiken bestehen.

6. Entwürfe und Urheberrecht

(1) Alle vom Dienstleister erstellten Entwürfe, Skizzen und Designs unterliegen dem Urheberrecht.
(2) Designs dürfen nicht kopiert, verändert oder an andere Tätowierer weitergegeben werden.
(3) Eine Nutzung der Designs außerhalb des Tattoo-Kontextes (z. B. für Logos oder Merchandise) ist ohne schriftliche Genehmigung untersagt.

7. Durchführung des Tattoos

(1) Der Kunde willigt ein, dass Designs und Abläufe während des Termins in Absprache angepasst werden können.
(2) Der Kunde erscheint nüchtern und ohne Alkohol- oder Drogeneinfluss.
(3) Der Dienstleister kann die Arbeit abbrechen, wenn das Verhalten oder der Zustand des Kunden die Durchführung gefährdet oder unzumutbar macht.

8. Nachsorge und Haftung

(1) Der Kunde erhält nach dem Termin Pflegehinweise, deren Befolgung in seiner eigenen Verantwortung liegt.
(2) Für Komplikationen oder Heilungsverläufe, die durch unsachgemäße Pflege entstehen, übernimmt der Dienstleister keine Haftung.
(3) Allergische Reaktionen oder individuelle Hautreaktionen können nicht ausgeschlossen werden.
(4) Nachstechtermine sind optional und kostenpflichtig, sofern nicht anders vereinbart.

9. Foto- und Bildrechte

(1) Der Dienstleister ist berechtigt, Fotos der erstellten Tattoos anonymisiert für Portfolio, Website oder Social Media zu nutzen.
(2) Der Kunde kann der Nutzung vor dem Termin ausdrücklich widersprechen.

10. Gutscheine

Der Dienstleister bietet keine Gutscheine an.

11. Reisekosten und Guest-Spots

(1) Bei Terminen außerhalb der regulären Arbeitsorte können zusätzliche Reise-, Übernachtungs- oder Materialkosten entstehen.
(2) Diese werden vor der Terminbestätigung transparent kommuniziert.

12. Salvatorische Klausel

Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.

TERMS AND CONDITIONS (T&C)

1. Scope

These Terms and Conditions apply to all services, appointments, bookings, and agreements between the tattoo artist (hereinafter “Service Provider”) and the client (hereinafter “Client”). By scheduling an appointment or submitting a request, the Client accepts these Terms and Conditions.

2. Appointments and Deposit

(1) An appointment is only considered confirmed once a deposit of 30% of the total price has been paid.
(2) Deposits are strictly non-refundable, regardless of the reason for cancellation.
(3) Cancellations or rescheduling must be communicated at least 14 days before the appointment date.
(4) A rescheduled appointment is allowed once and must take place within 3 months of the original date, provided that the change was made within the required notice period.
(5) Due to limited capacity and long-term planning, last-minute cancellations cannot be filled with new clients; this policy forms the basis for the non-refundable deposit.
(6) Deposits cannot be transferred to other people.

3. Cancellation and Rescheduling

(1) A cancellation or rescheduling request is only valid if communicated at least 14 days prior to the appointment through one of the following methods:

  • written message via WhatsApp,

  • written message via email, or

  • in person.

(2) Messages sent through social media platforms (Instagram, TikTok, Facebook, etc.) or any other channels are not accepted and do not constitute a valid cancellation or reschedule.

(3) If no timely or valid notice is given, the deposit is forfeited in full.

(4) In cases of multiple rescheduling requests, the Service Provider reserves the right to decide whether a new appointment can be granted.

4. Pricing and Payment

(1) Prices are determined by the size, style, placement, and complexity of the tattoo.
(2) A binding price can only be provided after discussing the concept or design.
(3) The remaining balance must be paid in full on the day of the appointment—either in cash or via an accepted electronic payment method.

5. Health Requirements

(1) The Client confirms that they are at least 18 years of age.
(2) The Service Provider will not tattoo individuals with the following conditions:

  • blood clotting disorders

  • use of blood-thinning medication

  • pregnancy or breastfeeding

  • infections, skin conditions, or open wounds in the tattoo area

(3) The Client is obligated to disclose any relevant health issues prior to the appointment.
(4) The Service Provider may refuse or discontinue the tattoo procedure if health concerns pose a risk.

6. Designs and Copyright

(1) All designs, sketches, and artwork created by the Service Provider are protected by copyright.
(2) Designs may not be copied, altered, or provided to other tattoo artists.
(3) Any use of the artwork outside the tattoo context (e.g., logos, merchandise) requires written permission.

7. Tattoo Procedure

(1) The Client agrees that adjustments to the design or process may occur during the appointment if necessary.
(2) The Client must arrive sober and free from the influence of alcohol or drugs.
(3) The Service Provider may stop the session if the Client’s condition or behavior makes the procedure unsafe or unreasonable.

8. Aftercare and Liability

(1) Aftercare instructions will be provided after the session. The Client is responsible for following these instructions.
(2) The Service Provider is not liable for complications or healing issues caused by improper aftercare.
(3) Allergic reactions or individual skin responses cannot be ruled out.
(4) Touch-up sessions are optional and subject to an additional fee unless otherwise agreed.

9. Photo and Media Rights

(1) The Service Provider may take photos of completed tattoos and use them anonymously for portfolio, website, or social media purposes.
(2) If the Client objects to this, they must communicate this before the tattoo session.

10. Gift Cards

The Service Provider does not offer gift cards.

11. Travel and Guest Spots

(1) Appointments outside the Service Provider’s regular working locations may incur additional travel, accommodation, or material costs.
(2) These costs will be communicated transparently prior to booking.

12. Severability Clause

If any provision of these Terms and Conditions is deemed invalid, the remaining provisions shall remain unaffected.
